Faq

As per the Foreign Exchange Management Act (FEMA), an NRI is:

 

  • An Indian citizen residing outside India for employment, business, or other purposes indicating an indefinite stay abroad.
  • A Person of Indian Origin (PIO) or Overseas Citizen of India (OCI) cardholder.

  • NRIs, PIOs, and OCIs can purchase residential or commercial plots in India without prior RBI approval.
  • Agricultural land, plantation property, or farmhouses cannot be purchased directly without specific RBI permission.

To proceed with a purchase, you will need:

 

  • Valid Passport (Indian/OCI/PIO card)
  • Overseas Address Proof (utility bill, driving license, etc.)
  • PAN Card (mandatory for property transactions)
  • Recent Passport Size Photographs
  • Power of Attorney (PoA) – If you cannot be physically present in India, a PoA (on Indian stamp paper and notarized/attested by Indian Embassy) can authorize a representative to act on your behalf.

  • Payments must be made in Indian Rupees through NRE/NRO bank accounts in India.
  • Accepted payment modes:
  1. Bank transfer from NRE/NRO account
  2. Demand Draft/Pay Order
  • Cash transactions are not permitted.

Before selling, VR Foundations ensures:

  • Clear Title & Ownership of the land
  • RERA Registration (if applicable)
  • DTCP/CMDA Approval for plotted layouts
  • Encumbrance Certificate (EC) verification

  • If the property is purchased using funds from an NRE account, proceeds from sale can be repatriated (within limits prescribed by RBI).
  • If purchased from an NRO account, repatriation is allowed up to USD 1 million per financial year after payment of applicable taxes.

  • TDS (Tax Deducted at Source) applies on sale of property in India.
  • You may also be liable for Capital Gains Tax based on holding period.
  • NRIs can claim tax benefits under Section 80C for home loan principal repayment (if applicable).
